LIMITED WARRANTY POLICY FOR NORAMENT 925, A & B, NORAMENT 825C NORAMENT 920S, 926S, 928S, 992S ECOMENT NORAPLAN ECOPLAN NORAMENT STAIRTREADS (EXCEPT FOR THE SAFETY GRIT STRIP)   Freudenberg Building Systems, Inc. ("FBS"), warrants the Nora Rubber Flooring and Nora Rubber Stairtreads (except for the safety grit strip) listed above to be free of defects in material or workmanship, for one year from the date of purchase. In addition, FBS warrants the above mentioned products against excessive wear according to the terms defined on the reverse side of this warranty. FBS also warrants the conductivity of the ESD-Flooring System (flooring and adhesive) according to the terms defined on the reverse side of this warranty. EXCEPT FOR THE LIMITED WARRANTIES SET FORTH ABOVE, FBS EXTENDS NO OTHER WARRANTIES OR GUARANTEES, WHETHER EXPRESSED OR IMPLIED INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, EXACT MATCHING OF A SHADE, COLOR OR MOTTLING, OR WARRANTIES FOR FITNESS FOR A PARTICULAR PURPOSE. FBS HEREBY DISCLAIMS ANY OTHER WARRANTY OR GUARANTEE UNLESS EXPRESSLY AUTHORIZED AND ENDORSED IN WRITING AS SET FORTH BELOW. No agent, employee or representative of FBS has any authority to bind FBS to any affirmation, representation or warranty concerning the goods sold under this contract, and unless an affirmation, representation, or warranty made by an agent, employee, or representative is specifically included within this written agreement, it shall not be enforceable against FBS by any buyer or end user. NOTICE OF CLAIMS To obtain performance of the limited warranties set forth above, written notice must be provided to Freudenberg Building Systems, Inc., 94 Glenn Street, Lawrence, MA, 01843, within thirty (30) days of discovery of any defects in the materials or workmanship and FBS must be given an opportunity to inspect and examine the allegedly defective product. LIMITATION OF LIABILITY UNDER WARRANTY NEGLIGENCE OR ANY OTHER CLAIM In no event and under no circumstances whatsoever shall Freudenberg Building Systems, Inc. (FBS), be liable for any losses, claims, or damages in excess of the costs of the good invoiced by FBS to the buyer or end user. In addition to the foregoing, FBS shall not be liable for incidental, consequential, enhanced or punitive damages. In the event that the product manufactured, distributed, or sold by FBS is found by its representative to be defective in either workmanship or material for the proper usage and service designed, FBS will replace the product free of charge but excluding all costs of transportation and installation. Under no circumstances shall FBS replace the product or be directly or indirectly responsible for any flooring or product which has not been properly installed or that is damaged in any way by buyer or end user as an improper subsurface preparation, improper repairs or maintenance, or any other mechanical influences relating to the flooring or product. This shall be the maximum liability of Freudenberg Building Systems, Inc., for any or all whether in tort, contract, or otherwise.
